These Terms govern access to the RuralReady website and Fire, Ranch and Farm operations services (“RuralReady,” “Service,” “we” or “us”). By creating an account, purchasing a subscription or using the Service, you agree to these Terms on behalf of yourself and, when applicable, the organization you represent. If you do not agree, do not use the Service.
1. Authorized organization and account owner
The account owner must be at least 18 years old, legally able to enter an agreement and authorized to act for the department, business, ranch, farm or other organization. Each user must sign in with an email account they own or are authorized to use. The owner must provide accurate information, protect account credentials, assign appropriate roles and promptly remove unauthorized users.
2. Permitted use
You may use RuralReady only for the authorized workspace connected to your account. You are responsible for all users you invite and for the legality, accuracy and appropriateness of submitted information. You may not bypass security, access another organization without permission, interfere with the Service, introduce malicious code, scrape protected areas, reverse engineer restricted portions, impersonate others, infringe rights or use the Service unlawfully.
3. Plans, payment and renewal
Plan features, usage limits, price and billing interval are shown before purchase. Stripe processes payment. Subscriptions automatically renew monthly or yearly, according to the interval selected at checkout, until canceled. Taxes may apply. Failed or reversed payments may result in limited or suspended access.
4. Customer data and permissions
You retain ownership of records, files, photos, map points and other content you submit (“Customer Data”). You grant RuralReady a limited, nonexclusive license to host, copy, process, transmit, back up and display Customer Data only as reasonably necessary to provide, protect, support and improve the Service or comply with law. You represent that you have the authority and permissions required to submit the data.
5. Organization access and exports
Authorized users may view or change shared records according to their roles. The organization owner is responsible for role assignments and for copies exported or shared by its users. Export formats and supported records may change as features improve. Organizations with statutory or contractual retention requirements must maintain any independent records required for compliance.
6. Safety-critical limitations
RuralReady is an administrative operations tool. It is not dispatch, CAD, 911, incident command, emergency notification, ePCR, official incident reporting, veterinary care, agronomic advice, accounting, legal advice or a regulatory filing service. Never rely on it as the sole source for emergency response, apparatus readiness, water availability, medication withdrawal, chemical application, financial reporting or legal compliance. The additional limits on the Safety & Liability page are incorporated into these Terms.
7. Third-party services
The Service may use or link to hosting, mapping, browser-notification, email, storage and payment providers. Third-party terms and privacy policies may also apply. RuralReady does not control their availability, accuracy or independent processing.
8. Intellectual property and feedback
RuralReady™, its software, design, branding and documentation are products and property of Homen Graphic Designs, except for third-party materials identified separately. Customer Data remains yours. If you voluntarily provide product feedback, you allow RuralReady to use it without restriction or compensation, provided we do not publicly identify your organization without permission.
9. Cancellation, suspension and termination
An organization owner may request cancellation through support. Cancellation stops future renewal and normally takes effect at the end of the current paid period. Payments are nonrefundable except where required by law or a written offer. We may suspend or limit access when reasonably necessary to protect users, data or the Service; investigate suspected misuse; address nonpayment or a legal requirement; or respond to material breach. Certain records may remain for a limited period in backups, security records, billing records or legally required files.
10. Service availability and disclaimer
The Service is provided “as is” and “as available” to the fullest extent permitted by law. We do not promise uninterrupted operation, error-free records, delivery of notifications, accuracy of third-party maps, preservation of every offline update or fitness for a particular regulatory or operational purpose.
11. Limitation of liability
To the fullest extent permitted by applicable law, RuralReady and its owner will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits, lost data, missed notifications, inaccurate maps, unavailable water sources, operational decisions or service interruption arising from use of the Service. To the fullest extent permitted by law, aggregate liability for any claim will not exceed the amount paid by the affected organization for the Service during the 12 months before the event giving rise to the claim.
12. Indemnification and insurance
To the fullest extent permitted by law, the subscribing organization agrees to defend, indemnify and hold harmless RuralReady and its owner from third-party claims, losses and reasonable costs arising from Customer Data, unauthorized or unlawful use, violation of these Terms, infringement of another person’s rights or operational decisions made by the organization or its users. Each organization remains responsible for maintaining insurance appropriate to its operations, vehicles, personnel, property, animals, cybersecurity and legal obligations. RuralReady is not an insurer.
13. Governing law and disputes
Unless applicable law requires otherwise, these Terms are governed by the laws of the State of Texas without regard to conflict-of-law rules. Before filing a claim, each party will provide written notice and make a good-faith effort to resolve the dispute informally. Subject to mandatory law, jurisdiction and venue will lie in the state or federal courts serving the county of RuralReady’s principal place of business.
14. General terms
These Terms, the Privacy Policy, Safety & Liability page, applicable policies and the plan selected at checkout form the agreement for the Service. If one provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver. The organization may not transfer its account or agreement without written consent; RuralReady may assign the agreement in connection with a business reorganization or sale. Electronic acceptance and records have the same effect as written acceptance to the extent permitted by law.
15. Changes and contact
We may update these Terms as the Service develops. Material changes will be presented through the website, account or contact information on file. Questions may be sent to homengraphicdesigns@gmail.com.
